Something is rotten about migrant workers’ entry rules

Is our country's defence system so bad? Forces involved include the Immigration Department, the Marine Police and the Navy, the Field Force, the Army and the Police. Why is the situation so bad? Why are millions of undocumented migrants on the streets?

Search, search and search for answers and the only conclusion is that the government is all for the influx of such undocumented migrants. Why? Money, Money, Money! Or is the government trying to create a new racial balance? If the government really does not condone undocumented entrants, are we then to believe that our coastline is so porous? Are we to believe that millions of undocumented foreigners can move around and live in our midst without care?

What are the authorities doing about handling the problem? Are we incapable? Don't we have the resources? Perhaps a Bersih-like demonstration is necessary to jolt the government into action! This situation is really getting impossible to take!

Let's not say that the 6P programme is set to resolve the problem. On the contrary, this programme is a colossal disaster. A programme that was initiated from the top i.e. the Cabinet committee under our DPM and the Home Ministry began with biometric machines being allegedly manipulated. People appointed by the top management … so how authentic is the data collected?

The implementation of the programme itself was postponed at least three times giving rogue and bogus agents a field day conning poor undocumented migrants, especially. I wonder if this was a deliberate act to allow (selected) agents to cash in on gullible victims? Besides, I hear, that hefty rentals were charged and agents told not to charge any fees at the 1st P stage. Who supplied these machines?

How do all these conditions make sense?

Then we had the police "being shocked" by the sheer number of undocumented migrants in the country and Hishammuddin going on screen quoting numbers (registered via the biometric system) and declaring "ini merupakan satu keadaan yang begitu serius".

Well done-lah, Hisham! But people on the ground knew it a long, long time ago!

On the other side, we have the Indonesian government making us beg for their domestic workers and the Malaysian government actually begging. Why do we need to? After all, millions have come and gone on their own free will. Do the Indonesians actually bother about what their government says? Just hop onto a boat, pay some money here and there and you are safely on Malaysian shores at a much cheaper rate.

Allowing the people to seek and bring their own choice of domestic help into the country through social visit passes and then having them registered seems a perfect solution. The onus is shifted to the employer and the domestic worker to satisfy themselves. We only need a proper monitoring system in place. But domestic worker agencies in Malaysia and Indonesia and the Indonesian Embassy are up in arms. Why? Money again!

In fact, The Star on Sunday (4 September) reported that the Indonesian embassy's minister counsellor for information, social and cultural affairs Suryana Sastradiredja warned Malaysian employers that they could be detained by Indonesian authorities because "direct recruitment violates our laws".

DAP Internal Party Squabble

It is well known publicly that Gwee Tong Hiang is a henchman of Lim Guan Eng. Recent development is the DAP organizing committee is facing an internal party squabble. This image will definitely affect adversely the efforts of the Northern Johor DAP election preparation.

The hot topic for discussion at kopitiam currently is whether Lim Guan Eng is prepared to let go and relieve Gwee Tong Hiang from all offices.

It is interesting to go back in history and absolutely humorous to note that the "Wei Zhong Xian" share common written Manderin words as "Gwee Tong Hiang" in Chinese. Just in case you do not take your Chinese History lesson, Wei Zhong Xian was a notorious eunuch during the Ming Dynasty about 450 years ago.

Tan Chen Choon
Prior to 2004, Tan Chen Choon tendered his resignation to the company he was working at as the company policy prohibited its employees from standing as candidates in the election. He lost his Bentayan State Seat in GE11 (with a slim margin of 428 votes) eventually. Tan lost his contest and his job after GE11. With no choice, but to earn his living and support his family, he became less active in the Bakri Liaison Committee. That left a big gap in the leadership problem that existed in The Committee.

In 2005, Gwee Tong Hiang promoted himself to be a candidate for the Bentayan State Seat, in direct opposition to Dr Boo Cheng Haw option. Because of this, Gwee severed relationship with Boo. Since then, he did not allow Boo to stay at his house in Muar. Before this, it was a practice to receive and be a host to a visiting comrade for economical reasons. And Boo's position had been replaced by Nga Ko Meng. This was obviously to set aside and also to undermine Boo's influence.

In 2007, 17 DAP members accused Gwee of improper execution of the sale and purchase of Wisma DAP Muar at Jalan Sakeh, especially with regard to the illegal omission of commission on the sale. When Lim Guan Eng heard about this news, he rushed to Muar and instructed Gwee to use legal means to bring the 17 members to court.
In 2008, Er Teck Hwa was elected Member of Parliament. He is an affable and patient person. But unfortunately on numerous occasions, Gwee treated Er as if the latter, was a lowly subordinate. Gwee has neither manners nor respect for a member of Parliament. Even a person of humble character, Er had no choice but to break away from Gwee.

Finally, Er decided to leave the DAP Bakri Parliamentery Constituency Liaison Committee. He left without any followers or financial resourses.
Lim Sey Wee

In 2009, Lim Sey Wee, a senior party leader, left Gwee. This being so despite being a former comrade of close rapport. On one occasion before the 12th GE, Lim even cried in front of reporters in defence of Gwee, about the WISMA commission scandal.

Shiew Kok Kong has been working together with Gwee for more then a decade. He has repeatly persuaded Gwee to share party resouces. But eventually he was also kicked out from the DAP Bakri Liaison Committee.

Although Shiew is the treasurer of Bakri Liaison Commttee at that time, in reality, he has never taken over all financial work. After a war of words through the media, Shiew eventually left the Bakri Liaison Committee which was established by him and Gwee.

In April, 2011 during the Sarawak Election. Gwee organized a supporting team from Bakri Liaison to go to Sarawak. During the campaign, Gwee demanded the members to wake up early and work till late night, and according to Gwee, this is all CEC's order. After that, he secretly brought his wife to Brunei, in order to compensate what he had missed out in the government trip to Northern Europe offered by Johor State Government. During the campaign period, when one of the member fell sick, he only gave a few Panadol strips without sending her to the nearest clinic. In their orignal agreement before they came to Sarawak, Gwee agree to use Bakri Liaison's fund to fully subsidize for the whole trip but after that Gwee requested one of the member to pay for the whole trip with the reason that the member has proposed in the meeting that using thier own pocket money instead of party fund for the trip. That made that member pissed off.

After that, Gwee's "personal secretery" Se Pei Teng (Se is Bentayan GE12 MCA's Bentayan State Seat candidate Chris Lee's secretary). Finally she also cannot tolerate Gwee and leave him. When Se submitted her resignation letter in one month's notice, Gwee refused to pay her the last month's salary. Gwee also accused Se for asking complainants to pay a fee for services done. As a normal practice, the DAP Service Center does not impose any charge to complainants.

On 25th August, all these were exposed in the Bakri Liaison election Committee. Gwee was not re-elected as Chairman, and it was eventually exposed that Bakri Liaison Committee is heading for bankruptcy under the leadership of Gwee. Although within these 4 years, they have organized 4 fund raising dinners with 200 tables at each dinner function and collected more than half a million ringgit.

Frankly speaking, as a State Assemblyman who always does his job well with "longkang and lubang" complaints, he also complained about teachers beating pupils. He tries his best to make friends with Tai Ko and loan sharks, and he is also making his efforts to expand more branches in the Bakri Constituency until the extent that all his branches occupy 20% of the total branches in Johor State. That gains him a nickname of "Johor's Ronnie Liu" . Besides that, he is also making his best effort to generate more enemies that he can take in. He prevents the advancement of, and suppresses members who have good potentials. Qualified members are a threat to him.

He is in constant fear of losing his seat, status and position. He complains about reporters. He ensures that every electorate's complaint can be published in local newspapers. All these finally caused reporters to write an article to complain about this state assemblyman.

The purpose we write this artcle is obvious. But please stop guessing who we are. Are we Boo's man, Er's man, or we are sent by BN; we are cyber-trooper of MCA. Could we be also reporters from the local newspaper, or are we also anonymous. It does not matter. And Gwee has really pissed us off this time, and we have caught him with his pants down.

On 25th August 2011, the DAP Bakri Constituency Liaison Committee held its annual party election. Many branches had been told that the Bakri Liaison Committee is facing financial crisis. More important is that, most of the participants have one common thinking in mind: protecting DAP, uphold Bentayan, and they want to teach Gwee a lesson. Out of 93 qualified representatives, 71 of them have attended the party election. This could rival DAP Selangor State Committee Election last year when they tried to bring the downfall of Ronnie Liu.

When the result was announced, Gwee lost his chairman seat. Nevertheless, these participants only wanted to teach him a lesson. He survived and was voted to became deputy President. According to reliable sources, the rest of the meeting failed to break the stalemate. They did not even complete the annual fianncial and secretary report!


While GE13 is coming anytime the Bakri Liaison Committee led by Gwee has only left 2 to 3 thousand ringgit in its account. That makes one to suspect whether he still wants to continue to fight for this seat or not. The most amazing thing is that, earlier on this year, the same account had 60 thousand ringgit.

Remember how the Malacca Sultanate was brought down?

Till now, there has been no official response from both sides as to the authenticity of the claims in that site. DSAI reportedly said here that he is asking his friends to verify the truth of that allegation. If that allegation is true, history may soon repeat itself if we are not careful to pay heed to all the signs of danger.

In the 16th century, the Malacca sultanate was brought down by merchants from India who were actually Trojan horses for the Portuguese who colonized Goa for 450 years.. The Sultan was stabbed in the back then by the Indian merchants who sold out the Sultan to the Portuguese.

According to this site:

Sultan Mansur took advantage of the breathing room he had won and gradually, through diplomacy, established good relations between the Thais and Melaka.


Would that all Melaka's rivals could have been won over by bluff followed by an olive branch! Unfortunately, a greater threat was to come from the West.


In September, 1509 European contact with the Malay Peninsula was established when a Portuguese squadron sailed into Melaka. They were considered oddities at first: The Malays called them Bengali putih, meaning "white Bengalis."


Melaka's Indian merchants are said to have pressured the sultan into attacking the Portuguese both because the merchants feared trade rivals and because word had reached them that the Portuguese were cruel to Muslims. The small squadron was duly driven off, leaving behind 20 Portuguese prisoners. (Curiously, one of the men who escaped was Ferdinand Magellan, whose fleet was later to become the first to circumnavigate the world.) Read more here.

Wikipedia says that "the Portuguese was helped by Guy Arojo, Chinese Capitans who supplied small ships to enter the Port of Malacca and the southern Indian and Javanese group who were in dispute with the Sultanate of Malacca."

Now, if that allegation is indeed true, we may have a situation where the status quo are depending on foreigners to keep them in power and once again, they WILL BE SOLD OUT - just like in the past!

In their greed for power, they have not learnt from history! If this were to happen,  the 'imported voters' will eventually become so significant they can grab the powers that be by the balls and demand all sorts of things and they will have no choice but to say yes.

Even if this is not true, let us not forget other incidents that happened in the last thirty years.

Southern Thais have been known to have fled to Kelantan as reported HERE and here although denials have been issued here refuting a Thai politician's claim that more than 200,000 southern Thai Muslims have fled the violence in the region and have taken refuge in Kelantan. Whatever the case, in the last 20 years, there have been concerns as to how even in Kelantan, foreigners could tip the scale in the ballot box.

All the usual suspects....

Imagine this…there is Najib at home sitting down for dinner with the Prime Minister…oops sorry …there is Najib sitting down for dinner with Rosmah.

As usual Rosmah briefs Najib on the REAL situation -  re the possibility of her remaining as FIRST LADY. It does not look to good. Her recent attempt (over Hari Raya) at having a regular spot on national TV to "connect" with the people of Malaysia bombed because the people did not want to connect with her! So how now brown cow? What else to do?

Tell the real story about Altantuya? No can do! Spending time behind bars is not what this First Lady wants to contemplate doing even in the company of her beloved Najib!

Fast track PKFZ? No can do. That would bring the whole BN house of cards tumbling down.

Clean up PDRM, MACC and the Judiciary? ..and leave UMNO up the Tembeling River in a raft without a paddle? No can do too!..there must be something else they can do without getting themselves wet.....Rosmah does not look to good without her makeup!

And then their "Eureka" moment…abolish the ISA! Nobody who is against them can say that abolishing the ISA is not a good thing! And while Najib is at it why not abolish the Printing Presses and Publication Act, etc etc.

Now of course it never occurred to them that it is "THEM" that the people wanted to abolish…but since when has what the people want been of any concern to Rosmah? Never!

This is what I like about Rosmah. She manages to offend all the right people...like all Malaysians! She thinks that making Najib abolish the ISA will secure her another tenure as First Lady. Well Rosmah I have news for you. Najib has to be reelected as PM first at the 13th general election to allow you to remain as First Lady – NOT The other way around!

Anyway the announcement has been made and all the usual suspects are wheeled out to put in their two cents worth of support.

Antara Liberalisasi dan Reaksi Kepada Pembangkang

Pada mulanya saya tidak bercadang mengulas perkembangan ini. Tapi setelah menerima beberapa pertanyaan dan komen melalui SMS, saya rasa perlu memberi sedikit ulasan awal.

1. AKDN atau Internal Security Act (ISA) ada penyokong tegarnya. Majoriti orang Melayu tidak ada masalah dengannya.  Sebahagiannya pula mempunyai kaitan emosi yang kuat dengan akta itu kerana ramai suku-sakat dan saudara-mara berjuang menentang komunis malah terkorban akibatnya;

2. Hanya Melayu liberal, Melayu muda yang tidak merasai pahit getir darurat dan peristiwa 13 Mei, 1969 atau yang buta sejarah saja yang mati-matian mahu AKDN dihapuskan;

3. Hatta Melayu di pihak pembangkang pun tidak semuanya menentang AKDN sehingga mahu ianya dihapuskan. Kalau mereka nampak mati-matian menentangnya, itu adalah "posturing" politik;

4. Ramai juga pemimpin pembangkang sekarang pernah menjadi penyokong kuat AKDN apabila mereka dalam kerajaan. Mereka adalah fait accompli kepada akta itu kerana tidak berbuat apa-apa bagi menghapuskannya ketika dalam kerajaan;

5. Kalau AKDN berguna kepada Kerajaan Barisan Nasional, ia pun berguna juga kepada Pakatan Rakyat kalau ia ditakdirkan menjadi kerajaan. Cuma sekarang, dengan cadangan pemansuhan akta itu, PR tidaklah berpeluang menggunakannya kalau berkuasa;

6. Kalau Kerajaan BN telah menggunakan AKDN ke atas pemimpin pembangkang, pemimpin pembangkang pun boleh menggunakan AKDN ke atas pemimpin BN kalau BN ditakdirkan kalah pilihan raya suatu masa nanti;

7. Pembangkang sudah pun mendakwa kemenangan. Kata mereka, kerana asakan merekalah, Perdana Menteri mengumumkan liberalisasi itu dan kalau mahu ianya ditunaikan, teruskanlah menyokong PR atau lebih baik lagi pilih PR sebagai kerajaan pada pilihan raya umum akan datang; 

8. Masalah yang sering ditimbulkan mengenai AKDN bukan undang-undang itu per se, tapi peruntukannya dan cara ia dikuatkuasakan oleh polis. Kalau itu masalahnya, cara terbaik adalah meminda akta itu;

9. Saya adalah antara penyokong AKDN. Pendirian saya tidak berubah. Tapi saya setuju yang beberapa peruntukan akta itu dipinda seperti yang dicadangkan dalam laporan Suruhanjaya Diraja Penambahbaikan Perjalanan dan Pengurusan Polis Diraja Malaysia bagi memendekkan tempoh siasatan dan mengelakkan penyalahgunaan kuasa oleh polis dan Menteri Dalam Negeri;

10. Suruhanjaya itu mencadangkan pindaan kepada AKDN sebagai tolak-ansur dengan PDRM yang mahu ianya dikekalkan. Saya tidak pasti kalau PRDM telah mengubah pendirian mengenai perlunya AKDN dikekalkan;

In Between The Lines

Undoubtedly, the next GE is imminent as can be seen in the many populist moves taken by the PM such as:

  • The repeal of the Internal Security Act (ISA) 1960
  • The enactment of  two new laws to safeguard peace and order 
  • The reduction of the detention period which can only be extended by the courts, except in cases involving terrorism.
  • The lifting of three remaining emergency proclamations - Emergency 1969, Emergency 1966 (Sarawak) and Emergency 1977 (Kelantan).
  • The repeal of the Banishment Act 1959
  • The replacement of the annual licence renewal requirement for newspapers and publications by a one-off permit by reviewing the Printing Presses and Publications Act 1984.
  • The review of  the Restricted Residence Act 1933.
  • The move to allow greater freedom to assemble by reviewing Section 27 of the Police Act 1967 taking into consideration Article 10 of the Federal Constitution which guarantees every citizen with the right to freedom of speech and assembly

Note that the above changes would have to be tabled in Parliament.

Earlier, the PM had also announced (despite our RM362billion debt) :

  • Bonus payments for civil servants despite our deficit
  • A cash payout for farmers
  • Affordable housing for low-income earners 
  • and other favourable statements to hike his popularity ratings.
Consider the context of such 'positive' developments and then read between the lines before we celebrate. It is immature and foolhardy of Pakatan leaders to "have taken credit for Datuk Seri Najib Razak's decision to repeal the Internal Security Act 1960 (ISA) as well as several law reforms, saying the prime minister's move was a direct rip-off from their Buku Jingga plans" (read this report). I am not saying their Buku Jingga is not a good idea but even without its existence, any sharp political strategist would have known what to do in the light of the existing political landscape whereby the status quo is losing support and popularity because of the rakyat's outrage over:

  • the removal of subsidies leading to the rising cost of living
  • the announcement that the GST is likely to be introduced after the next GE
  • the slow pace of political and electoral reforms, especially after Bersih 2.0
  • Bersih 2.0
  • the widening religious discontent starting from the 'Allah' controversy, the cow-head episodes, church burning, DUMC incident
  • debate over what is or what is NOT historical facts
  • corruption issues
  • the PKFZ scandal
  • the TBH case and Ahmad Sarbani
  • death in custody issues/cases including Kugan's death and many others
  • the recent Air Asia-MAS swap deal, imposition of new charges etc
  • the ETP issues
  • many $$$ issues that have dented the image of the government including the Scorpene submarines, RM 6billion patrol boats, 100 storey Warisan Merdeka, Save Malaysia Stop Lynas issue, Ng Yen Yen's RM1.8 million social media campaign or her RM3.25 million expenditure on overseas trips 
  • and many other reports which have outraged the rakyat
The recent development is a successful ploy to deflect the rakyat's focus on real issues that concern each and every one of us. And the Opposition leaders are being led by their noses to follow the red herring trail thrown in their path!

One must question:

1. Could the new laws that will replace the Internal Security Act be used against political targets in the same way as how the ISA was used previously?

2. If indeed Malaysia practises democracy and upholds freedom of the press/expression/assembly and all the pillars of democracy, there should not be the need for a media license in the first place. Read this excellent discussion.

3. Bear in mind that one of the government's most powerful tools is the sedition laws which has been used to silence critics as it "criminalises speech with "seditious tendency", including that which would "bring into hatred or contempt or to excite disaffection against" the government or engender "feelings of ill-will and hostility between different races" (Source: Wikipedia).

In this post,  I discussed Mat Sabu's sleight of hand to deflect interest in the DUMC and Sodomy issues by throwing a red herring in BN's path.

Subsequently, the whole nation went on a warpath to debate historical issues. I had never seen such an outburst of 'historical knowledge and yours truly also joined the bandwagon HERE, Malaysia - Part 1, Malaysia - Part 2 and Malaysia - Part 3.

And then the announcement last night. Perfect timing! Currently, our PM Najib has the option of holding snap polls to cut his losses or to delay elections to give him time to gain ground for a bigger win.

It was People Power that finished off the ISA

Most people would be inclined to welcome these announcements. But we would be well advised to temper any celebration with caution. What will replace these oppressive laws is not clear and has not yet been revealed in much detail.

The repeal of the ISA and EO is an acknowledgement that the government can no longer sustain the use of these laws without strong public condemnation and opposition. The repeal of these two laws is the only logical move.

Massive public rallies have driven the final nail into the coffin of these obnoxious laws. The people, inspired and spurred on by the civil society Abolish ISA Movement (GMI), have won a remarkable victory through their persistent and determined opposition to the ISA. For that, the people have to be congratulated.

The repeal of the ISA and EO, however, will not erase the suffering of all the detainees down the ages who have unjustly suffered at the hands of an oppressive state apparatus. Countless lives have been ruined. An independent tribunal is needed to look into all cases of ill-treatment and torture, psychological or otherwise, that have surfaced over the years. Those who have been abused and ill-treated and incarcerated without trial for years – or their families – must be adequately compensated. Those responsible for ill-treating or abusing detainees must be brought to book as a lesson for others who may be tempted to continue in similar ways.

Meanwhile, other laws that restrict human rights such as the Sedition Act, the Police Act, the Universities and University Colleges Act and the Official Secrets Act must also be repealed as a sign of sincerity on the part of the BN. The same goes for other preventive detention laws.
